Terms of Service

These Terms of Service ("Terms") are a binding agreement between you and NW Functional Fitness LLC, doing business as F45 Training West Seattle ("we," "us"), governing your access to and use of this website and the F45 West Seattle Insiders list (the "Services"). By using the Services you agree to these Terms.

1. The Insiders list

F45 Training West Seattle has not opened yet. The Insiders list is a free pre-opening interest list. It is not a membership, a reservation, a purchase, or a contract for services, and joining does not guarantee availability, pricing, or a spot in any pre-sale or Founding Membership release. Opening dates, pricing, schedules, and offers are subject to change.

2. Eligibility

You must be at least 18 years old and legally able to enter into a contract to use the Services. By using the Services you represent that you meet these requirements, that the contact information you provide is accurate and current, and that the mobile number you submit belongs to you.

3. Communications consent

By submitting the form you agree that we may contact you by email and, if you check the SMS consent box, by text message. Consent to receive text messages is not a condition of any purchase. 4. Pre-sale offers

Any pre-sale or Founding Membership offer we later announce will be governed by its own terms and by the membership agreement you sign at that time. Offers may be limited in quantity and time, may be withdrawn or modified, and are subject to studio opening. Nothing on this website is an offer to sell a membership.

5. Acceptable use

• Do not provide false, misleading, or fraudulent information.
• Do not submit a phone number or email address that is not yours.
• Do not use the Services to violate any law or the rights of others.
• Do not interfere with, disrupt, probe, or attempt to gain unauthorized access to the Services or related systems.
• Do not use automated means (scrapers, bots) to access or submit to the Services.

6. Health and fitness disclaimer

Content on this site is provided for general information and is not medical advice. Consult a physician before beginning any exercise program. Individual results vary; testimonials and transformation images reflect individual experiences and are not a guarantee of results.

7. Intellectual property

The Services, including text, graphics, logos, photography, and software, are owned by NW Functional Fitness LLC or its licensors, including F45 Training brand assets used under license, and are protected by intellectual property laws. You receive a limited, revocable, non-exclusive, non-transferable license to use the Services for their intended purpose.

8. Third-party services

The Services rely on third-party providers for hosting, database storage, automation, email, and text message delivery. Your use of those providers' services is also subject to their terms and privacy policies. We are not responsible for third-party services.

9. Disclaimers

THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE.

10. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, NW FUNCTIONAL FITNESS LLC AND ITS AFFILIATES WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL ARISING FROM YOUR USE OF THE SERVICES. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SERVICES WILL NOT EXCEED USD $100.

11. Indemnification

You agree to defend, indemnify, and hold harmless NW Functional Fitness LLC and its affiliates from any claim, demand, loss, or expense (including reasonable attorneys' fees) arising out of your use of the Services, your violation of these Terms, or your violation of any law or the rights of any third party.

12. Termination

We may suspend or terminate your access to the Services, or remove you from the Insiders list, at any time and for any reason, including violation of these Terms. Sections that by their nature should survive termination will survive.

13. Governing law

These Terms are governed by the laws of the State of Washington, without regard to its conflict of laws rules. The state and federal courts located in King County, Washington will have exclusive jurisdiction over any dispute arising from these Terms or the Services.

14. Changes to these Terms

We may update these Terms from time to time. The "Last updated" date above reflects the most recent revision, and continued use of the Services after a change means you accept the updated Terms.
